1. PREAMBLE

These Terms of Use (ToU) apply to the crazy-canary.com website, operated by Crazy Canary LLC

2. AGE RESTRICTION

You must be at least 18 years old to use the site and request our services. By using the site, you confirm that you are at least 18 years old and have the legal capacity to enter into agreements. If you do not accept these Terms, you are not granted any license to access the site or its services. These Terms apply subject to the laws and regulations in force that are applicable to your situation.

3. GENERAL INFORMATION

Crazy Canary provides a consulting and booking assistance service. We help users find duly licensed and insured local providers, compare their public offers, and submit booking requests.
We do not resell activities and will never collect payments on behalf of the providers. The activity contract is entered into directly between the participant and the provider.

4. FORMALITIES AND INSURANCE

Crazy Canary acts solely as an independent advisor As such, we do not provide insurance and are not responsible for participants’ personal insurance coverage.

  • Each partner operator is required to hold the necessary legal authorizations to conduct their business, as well as professional liability insurance covering clients during the activity.


  • It is the responsibility of each participant to verify and/or personally take out additional travel insurance (cancellation, repatriation, medical expenses, etc.), which is often included with certain bank cards.

  • Participants must also ensure they have valid documents (passport, visa, driver’s license, medical certificates if required, etc.) and comply with all current administrative and health formalities.

Crazy Canary accepts no liability for any failure by the participant to meet these obligations.
A participant who is unable to take part in an activity due to missing valid documents or adequate insurance will not be entitled to any refund from us or from the operator.

5. DEFINITIONS

Crazy Canary LLC
A company registered in the State of Wyoming (USA), operating the crazy-canary.com website, acting as a consulting and booking assistance service for tourist activities. Crazy Canary does not resell activities and never collects payment for them.

Local Operator or Partner
A duly licensed and insured third-party company with which Crazy Canary collaborates to offer Users leisure activities and excursions. The operator designs, prices, sells, and carries out the Activity under its sole responsibility.

Participant
Any individual registered to take part in an Activity booked with the assistance of Crazy Canary.


User or You
Any individual or legal entity accessing, visiting, or using the site, regardless of the means or purpose of their visit.

Activity
An entertainment, sport, leisure, or excursion service provided exclusively by a duly licensed and insured Local Operator or Partner.

Public Price (PVP)
The Local Operator’s or Partner’s public rate, as displayed or communicated by them at the time of booking.

Partner Rate or Negotiated Rate
Preferential pricing conditions that the Operator may choose to apply to clients referred by Crazy Canary, at their sole discretion and subject to availability, dates, and their commercial policy. The rate is set and billed by the Operator. Crazy Canary requests these conditions and helps facilitate their application but does not guarantee they will be granted.

Crazy Canary Service Fees
Fees charged by Crazy Canary LLC for consulting, matchmaking, and assistance – including via WhatsApp – up until the day of the Activity. These fees are separate from the price of the Activity and do not constitute payment for it.

Advance on Service Fees


Amount paid by the Participant at the start of the engagement, deducted from the Crazy Canary Service Fees as payment for the consulting and coordination work already undertaken. This advance does not constitute payment for the Activity, which is paid directly to the Operator.

Booking Authorisation or Mandate
Authorisation given by the Participant to Crazy Canary to forward their request and contact details and, where applicable, to carry out the necessary steps to book with the Operator chosen by mutual agreement. This process does not involve Crazy Canary collecting any payment for the Activity.

Confirmation
Email or WhatsApp message summarising the Activity, date, time, meeting point, useful instructions, and, where applicable, the payment link for the Advance on Service Fees.

Unforseen Circumstances
An external, unforeseeable, and irresistible event that makes performance by either party impossible – e.g. cancelled flight, transport strike, illness with medical certificate, extreme weather event. Supporting documents may be requested.

Durable Medium and Evidence
Email, SMS, or WhatsApp messages kept by the Participant and by Crazy Canary, serving as proof of requests, confirmations, and communications.

Payment made by the Participant directly to the Operator, according to their terms (card or cash) and currency, after any applicable Partner conditions have been applied by the Operator. Crazy Canary never collects payment for the Activity.

Target Price
The aim is for the total of the price charged by the Operator and the Crazy Canary Service Fees not to exceed, in principle, the Public Price in effect at the time of booking. Occasional differences may occur due to availability, the Operator’s policies, exchange rate fluctuations, or rounding.


Article 1 — Description of the Services and the Site

1.1 The crazy-canary.com website allows you to request personalised advice, access descriptive information about activities, and ask for your contact details and preferences to be forwarded to selected providers.
1.2 Nature of Crazy Canary’s Role
Crazy Canary is neither an organiser nor a retailer of package travel within the meaning of EU Directive 2015/2302. Providers design, price, sell, and deliver their activities under their sole responsibility.
1.3 No Resale
Activity payments are made directly to the provider using their chosen payment methods. Crazy Canary issues, where applicable, a separate invoice for its service fees only..

Quote requests are free of charge and reserved for adults. You agree to provide accurate information and not to use the site to promote your own services or submit abusive requests. Any false declaration may expose you to the penalties provided for by law.

Article 4 — Booking and Payment

4.1 Process
Following the consultation, Crazy Canary forwards your request and preferences to the local provider or directs you to their booking procedure. The activity contract is concluded directly between you and the provider, who confirms the booking and collects payment for the activity.
4.2 Changes and Cancellations by the Provider
Any changes, postponements, or cancellations due to weather, safety, equipment availability, or any other reason are subject to the provider’s terms, as stated in their description or quote. Any refunds that may be due for the activity are handled by the provider in accordance with their policies.
4.3 Cancellation or Change by the Participant
All requests must be made to Crazy Canary, who will forward them to the provider. Any fees, penalties, or inability to make changes are determined by the provider.
4.4 Separate Payments
a) Price of the Activity Paid directly to the provider according to their payment methods and currency.
b) Crazy Canary Service Fees Billed separately by Crazy Canary for consulting and coordination. An advance on service fees may be requested at the start of the engagement.
4.5 Preferential Conditions Granted by Providers
In some cases, the provider may offer clients referred by Crazy Canary preferential rates compared to their public price. These benefits are decided and applied by the provider, subject to dates, availability, group sizes, internal policies, and cannot be combined with other offers. They are not guaranteed.
4.6 Target Price
Our ongoing goal is for the total amount charged by the provider, plus our service fees, not to exceed, in principle, the public price in effect at the time of booking. Occasional differences may occur due to exchange rate fluctuations, rounding, unavailability, display errors, or the provider’s policies.

Article 5 — Liability

5.1 General Provisions
Crazy Canary is bound by an obligation of means for its consulting service. It is not liable for indirect or intangible damages, such as loss of opportunity, loss of profit, or commercial harm.
5.2 Site Access
Access requires a high-speed Internet connection. Crazy Canary is not responsible for slowdowns, interruptions, technical errors, or contamination of users’ equipment.
5.3 Quote Content
Activity quotes are prepared by the providers. Crazy Canary is not responsible for errors or omissions in quotes or descriptions provided by third parties.
5.4 Activities Carried Out by Providers
The provider is solely responsible for the proper execution of the activity, its safety, and for holding the necessary authorisations and insurance. In case of any issues, Crazy Canary will assist in facilitating communication but does not replace the provider.
5.5 Maintenance
Maintenance operations may result in temporary suspension of site access, without liability on the part of Crazy Canary.
5.6 Force Majeure
Neither Crazy Canary nor the user shall be held liable for any failure caused by an event of unforseen circumstances, as defined under applicable law.

Article 6 — Right of Withdrawal

6.1 Crazy Canary Service Fees
For service fees sold remotely, the 14-day right of withdrawal applies as long as the service has not been fully performed with your consent. Performance begins when we deliver our personalised proposals and start our coordination efforts. If the service is fully performed before the withdrawal period expires and with your consent, you acknowledge that you waive your right of withdrawal for our service fees.
6.2 Dated Activities Sold by Providers
Leisure activities provided on a specific date or within a set period are not subject to the statutory right of withdrawal. Cancellations and refunds are subject to the provider’s terms and conditions.

Article 7 — Personal Data and Cookies

The processing of your data is described in our Privacy Policy, available via the footer link. It sets out the purposes, legal bases, retention periods, data subject rights, and contact methods. If the entity responsible is located outside the EU but targets EU residents, an EU representative is appointed, and their contact details are provided in the Privacy Policy.
The cookie banner allows you to accept or refuse non-essential trackers with the same level of ease. You can change your preferences at any time.

Article 8 — Intellectual property

The site’s content – text, photos, logos, and trademarks – is protected. Any reproduction, adaptation, or distribution without permission is prohibited. Provider content remains the property of its respective owners.

You pay the provider directly for the activity. Our service fees are separate and cover the time spent on research, negotiation, and coordination. Our pricing goal is that the provider’s price plus our service fees should not, in principle, exceed the public price in effect at the time of booking, subject to the specific cases outlined in the Terms of Use.
